You would not buy a house from me if you did not know that I owned it.
And I would not sell it to you unless we had both signed a contract of sale,
and exchanged signed transfers and mortgages. The same can be said of the
transactions between LIXI and its Members and Licensees.
When you become a Member of LIXI you are asked to sign the LIXI Membership
Application, acknowledging the LIXI Membership Terms and Conditions. These
enshrine the benefits and obligations of Membership, including your right to
vote at the LIXI AGM for the Board of Directors.
When you take out a LIXI Licence, you are asked to sign the LIXI End User
Licence Agreement (EULA). The EULA sets out the terms and conditions on which
you are entitled to use the LIXI Standards.
In both cases, you are also asked to initial the LIXI IP Policy to
acknowledge that you have read and agree to its terms. The IP Policy is
particularly important, because it ensures that your contributions to the
development of the LIXI Standards are used only for that purpose; and
conversely that the LIXI Standards are the property of LIXI.
Probably due to an administrative oversight, many Members and Licensees
have not been signing and returning their forms, even though in most cases they
have paid their fees.
This creates a problem for LIXI, in that without holding the necessary
executed documents, LIXI is less able to protect its intellectual property
in the LIXI Standards and may find it more difficult to ensure that Members
and Licensees play by the rules. These are the rules that we, as an industry,
have determined should apply to the development and use of the LIXI Standards.
The LIXI Standards belong to the whole industry. Ensuring that ownership is
protected is in the interests of the whole industry. Please do the right thing,
and ensure that you have completed and signed all of the relevant documentation
when you submit your payment for 2008.
